Why do you ask? Under what circumstances could it possibly matter? (apart from crossing shipping lanes and going into restricted areas)
A raceboard going full pelt with a tailwind can barely get up to the 5 knot speed limit let alone exceed it.
For starters vessels have to give way to swimmers Including surfers, and if a SUP is in waves with Kiters or sailboarders and is a vessel then it has to follow the same RoW rules.
Ahhh, yes that is disappointing that this is about a hidden agenda rather than a real question.(again!). It's all about sharing waterways and respecting other users. In the surf you follow surf etiquette no matter what board - this has been flogged to death in recents posts.
On waterways you should follow marine traffic rules, whether you are on a SUP, a prone board, surf ski, rowing shell, you are sharing the waterway with other users, traffic rules are for your safety and theirs (there are certain exceptions for paddle craft). Marine rules are very logical and practical.
As far as downwinding is concerned in WA, if you are 400m offshore (according to the water police) you require PFD type 1 (inflatable is fine) and a flare. The local police are really practical with this. It isn't about surfing, but if you are downwinding and 1-2km offshore, they may come and tap you on the shoulder if you don't have the right safety equipment.
Water sports having always been about sharing the asset and looking out for each other. Just have fun
